NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 003-001, MONROE BAY AND VICINITY
EFFECTIVE 15 MAY 2026
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia.
1. The “Notice and Description of Shellfish Area Condemnation Number 003-001, Monroe Bay and Vicinity,” effective 15 July 2025, is cancelled effective 15 May 2026.
2. Condemned Shellfish Area Number 003-001, shown as Sections A through D, is hereby established effective 15 May 2026. As to Sections A and B; it shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. As to Sections C and D; it shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose. The boundaries of these areas are shown on the map titled “Monroe Bay and Vicinity, Condemned Shellfish Area Number 003-001, 15 May 2026” which is part of this notice.
3. Conditionally Approved Shellfish Area (Closed Status) Number 003-001, shown as Sections M1 through M7, is hereby established effective 15 May 2026. It shall be unlawful for any person, firm or corporation to take shellfish from these areas during such period for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Monroe Bay and Vicinity, Condemned Shellfish Area Number 003-001, 15 May 2026” which is part of this notice.
4. Conditionally Approved Shellfish Area (Open Status) Number 003-001, shown as Section M8, is hereby established effective 15 May 2026. It shall be unlawful for any person, firm or corporation to take shellfish from this area during such period for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of this area are shown on the map titled “Monroe Bay and Vicinity, Condemned Shellfish Area Number 003-001, 15 May 2026” which is part of this notice.
5. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 003-001
A. The condemned area shall include that portion of the Potomac River and all of Monroe Bay inland and upstream of a line drawn between latitude/longitude map coordinate (38°13'26.8",-76°57'59.3"), map coordionate (38°13'33.5",-76°57'34.7"), and map coordinate (38°13'49.3",-76°57'44.2"); but excludes the areas defined as Sections C and D.
B. The condemned area shall include that portion of Mattox Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (38°12'35.8",-76°58'28.5") and map coordinate (38°12'49.2",-76°58'09.4").
C. The condemned area shall include that portion of Monroe Creek inland of a line drawn between latitude/longitude map coordinate (38°14'30.2",-76°58'14.7"), map coordinate (38°14'27.8",-76°58'09.6"), and map coordinate (38°14'26.8",-76°58'10.2").
D. The condemned area shall include that portion of Monroe Creek and its tributaries upstream of a line drawn between latitude / longitude map coordinate (38°14'54.1",-76°58'11.7") and map coordinate (38°14'53.9",-76°57'56.9").
M1. The conditionally approved area (closed status) shall include that portion of Monroe Bay inland of a line drawn between latitude / longitude map coordinate (38°13'45.1",-76°57'59.5") and map coordinate (38°13'46.3",-76°57'47.1"), but also downstream of a second line drawn between map coordinate (38°13'51.3",-76°58'02.0"), map coordinate (38°13'58.4",-76°57'56.3"), and map coordinate (38°13'56.6",-76°57'40.7"); and is shown as part of Section A.
M2. The conditionally approved area (closed status) shall include that portion of Monroe Bay inland of a line drawn between latitude / longitude map coordinate (38°14'15.6",-76°57'41.5"), map coordinate (38°14'25.5",-76°57'54.7"), and map coordinate (38°14'28.3",-76°57'51.4"); and is shown as part of Section A.
M3. The conditionally approved area (closed status) shall include that portion of Monroe Bay inland of a line drawn between latitude / longitude map coordinate (38°14'44.1",-76°57'51.9"), map coordinate (38°14'44.1",-76°57'57.9"), map coordinate (38°14'35.7",-76°58'08.1"), map coordinate (38°14'28.8",-76°57'59.2"), and map coordinate (38°14'36.9",-76°57'47.2"); and is shown as part of Section A.
M4. The conditionally approved area (closed status) shall include that portion of Monroe Bay and Monroe Creek inland of a line drawn between latitude / longitude map coordinate (38°15'03.7",-76°58'04.8"), map coordinate (38°15'00.4",-76°58'07.4"), map coordinate (38°14'50.1",-76°58'02.0"), and map coordinate (38°14'50.2",-76°57'54.4"); and is shown as part of Sections A and D.
M5. The conditionally approved area (closed status) shall include that portion of Monroe Bay inland of a line drawn between latitude / longitude map coordinate (38°14'00.7",-76°58'16.5"), map coordinate (38°14'05.2",-76°58'07.2"), map coordinate (38°14'01.3",-76°58'03.8"), and map coordinate (38°13'57.7",-76°58'11.7"); and is shown as part of Section A.
M6. The conditionally approved area (closed status) shall include that portion of Mattox Creek inland of a line drawn between latitude / longitude map coordinate (38°12'16.0",-76°59'21.2"), map coordinate (38°12'15.2",-76°59'21.7"), map coordinate (38°12'13.3",-76°59'17.4"), map coordinate (38°12'18.5",-76°59'14.4") and map coordinate (38°12'19.5",-76°59'17.3"); and is shown as part of Section B.
M7. The conditionally approved area (closed status) shall include that portion of Mattox Creek inland of a line drawn between latitude / longitude map coordinate (38°12'12.1",-76°59'00.5") and map coordinate (38°12'27.9",-76°58'51.9"); and is shown as part of Section B.
M8. The conditionally approved area (open status) shall include all of the unnamed cove of Mattox Creek inland of a line drawn between latitude / longitude map coordinate (38°12'17.5",-76°57'42.5"), map coordinate (38°12'22.5",-76°57'39.4"), map coordinate (38°12'22.5",-76°57'35.4"), and map coordinate (38°12'17.6",-76°57'33.3"); but is shown in the report only.
