NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 004-184, CURRIOMAN BAY
EFFECTIVE 15 FEBRUARY 2025
Pursuant to Title 28.2, Chapter 8, §§ 28.2-203 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia:
1. The “Notice and Description of Shellfish Area Condemnation Number 004-184, Currioman Bay”, effective 15 February 2024, is cancelled effective 15 February 2025.
2. Shellfish Condemnation Area Number 004-184, shown as Sections A, B and C, is hereby established, effective 15 February 2025. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Currioman Bay, Condemned Shellfish Area Number 004-184, 15 February 2025” which is part of this notice.
3. The Conditionally Approved Shellfish Area (closed status) Number 004-184, shown as Section M1, is hereby established effective 15 February 2025. It shall be unlawful for any person, firm or corporation to take shellfish from this area during such period for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of this area are shown on the map titled “Currioman Bay, Condemned Shellfish Area Number 004-184, 15 February 2025” which is part of this notice.
4. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 004-184
A. The condemned area shall include all of Cold Harbor Creek and its tributaries upstream of a line drawn from latitude / longitude map coordinate (38°09'45.3",-76°46'18.3") to map coordinate (38°09'25.5",-76°45'51.7").
B. The condemned area shall include all of Currioman Creek and its tributaries upstream of a line drawn from latitude / longitude map coordinate (38°09'05.2",-76°45'39.2") to map coordinate (38°08'55.1",-76°45'32.2").
C. The condemned area shall include all of Poor Jack Creek and its tributaries upstream of a line drawn from latitude / longitude map coordinate (38°08'11.4",-76°44'43.1") to map coordinate (38°08'10.2",-76°44'41.8").
M1. The conditionally approved area (closed status) shall include that portion of Cold Harbor Creek lying inland of a line drawn from latitude/longitude map coordinate (38°09'32.3",-76°46'19.9"), map coordinate (38°09'30.3",-76°46'17.1"), map coordinate (38°09'26.7",-76°46'18.5"), and map coordinate (38°09'27.5",-76°46'24.6"); and is included in the area defined as Section A.
