NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 004-082, NOMINI CREEK
EFFECTIVE 15 MARCH 2026
Pursuant to Title 28.2, Chapter 8, §§ 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia:
1. The “Notice and Description of Shellfish Area Condemnation Number 004-082, Nomini Creek,” effective 15 February 2025, is cancelled effective 15 March 2026.
2. Condemned Shellfish Area Number 004-082, shown as Sections A through E, is hereby established effective 15 March 2026. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas, for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Nomini Creek, Condemned Shellfish Area Number 004-082, 15 March 2026” which is part of this notice.
3. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.
BOUNDARIES OF CONDEMNED AREA NUMBER 004-082
A. The condemned area shall include that portion of the North Prong of Buckner Creek and its tributaries upstream of a line drawn from latitude / longitude map coordinate (38°08'35.5",-76°42'35.4") to map coordinate (38°08'29.5",-76°42'27.2").
B. The condemned area shall include that portion of Buckner Creek and its tributaries upstream of a line drawn from latitude / longitude map coordinate (38°07'45.4",-76°42'00.1") to map coordinate (38°07'47.1",-76°41'50.2").
C. The condemned area shall include all of Jules Creek and its tributaries upstream of a line drawn from latitude / longitude map coordinate (38°06'49.2",-76°42'33.1") to map coordinate (38°06'52.2",-76°42'29.5").
D. The condemned area shall include that portion of Nomini Creek and its tributaries upstream of a line drawn from latitude / longitude map coordinate (38°06'21.6",-76°43'54.2") to map coordinate (38°06'11.8",-76°43'47.9").
E. The condemned area shall include all of Davis Creek and its tributaries upstream of a line drawn from latitude / longitude map coordinate (38°06'05.9",-76°42'52.4") to map coordinate (38°06'06.6",-76°42'51.6").
