{"id":1391,"date":"2025-09-25T20:07:09","date_gmt":"2025-09-25T20:07:09","guid":{"rendered":"https:\/\/www.vdh.virginia.gov\/piedmont\/?page_id=1391"},"modified":"2026-02-26T19:51:22","modified_gmt":"2026-02-26T19:51:22","slug":"migrant-labor-camps","status":"publish","type":"page","link":"https:\/\/www.vdh.virginia.gov\/piedmont\/migrant-labor-camps\/","title":{"rendered":"Migrant Labor Camps"},"content":{"rendered":"<h1 style=\"text-align: center;\"><strong>MIGRANT LABOR CAMPS<\/strong><\/h1>\n<h2>What is a Migrant labor camp?<\/h2>\n<p>Migrant Labor Camps or &#8220;camp&#8221; means one or more structures, buildings, tents, barracks, trailers, vehicles, converted buildings, and unconventional enclosures of living space, reasonably contiguous, together with the land appertaining thereto, established, operated or used as living quarters for one or more persons, one or more of whom is a migrant worker engaged in agricultural or fishing activities, including related food processing.<\/p>\n<p>&#8220;Migrant labor camp&#8221; does not include (i) a summer camp, campground or hotel as defined in \u00a7\u00a0<a href=\"https:\/\/law.lis.virginia.gov\/vacode\/35.1-1\/\">35.1-1<\/a>\u00a0of the Code of Virginia, (ii) housing that, in the ordinary course of business, is regularly offered to the general public on a commercial basis and is provided to any migrant worker on the same or comparable terms and conditions as provided to the general public, or (iii) small businesses that are exempt under federal law as provided in the Fair Labor Standards Act (29 USC \u00a7 201 et seq.) and the Migrant and Seasonal Worker Protection Act (29 USC \u00a7 1801 et seq.).<\/p>\n<p>The agricultural industry employs a substantial number of migrant farm workers in the planting, cultivating, harvesting, and packaging of the many crops grown\u00a0throughout\u00a0the Commonwealth of Virginia. The Virginia Department of Health promulgates and enforces regulations to ensure the safe and healthy living conditions of migrant workers and their families during their employment and residence in Virginia.<\/p>\n<h2>What do I have to do if I plan to operate a Migrant Labor Camp?<\/h2>\n<p>If you are proposing to operate a migrant labor camp in Piedmont Health District, please consult with the Environmental Health Specialist assigned to the County Health Department in the locality of your proposed camp location.\u00a0\u00a0 Prior to submitting application to the Health Department, consult with the Virginia Employment Commission office for your locality for their guidance and requirements to operate.\u00a0 When you have been instructed to do so by the Virginia Employment Commission, submit your migrant camp permit application to the County Health Department of the proposed camp location.<\/p>\n<p><a href=\"..\/..\/Environmental%20Health\/FORMS\/Migrant%20Labor%20Camp\/PrintFormMLC-Migrant%20Labor%20Camp%20Application.docx\">Migrant Labor Camp Permit Application<\/a><\/p>\n<p><a href=\"https:\/\/law.lis.virginia.gov\/admincode\/title12\/agency5\/chapter501\/\"><strong>Chapter 501.
