NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
\nNUMBER 003-146, POPES CREEK<\/p>\n

EFFECTIVE 23 SEPTEMBER 2008<\/p>\n

Pursuant to Title 28.2, Chapter 8, \u00a7\u00a7 28.2-803 through 28.2-808, \u00a7 32.1-20, and \u00a7 2.2-4002, B.16 of the Code of Virginia:<\/p>\n

1. The \u201cNotice and Description of Shellfish Area Condemnation Number 003-146, Potomac River: Popes Creek,\u201d effective 22 September 2008, is cancelled effective 23 September 2008.<\/p>\n

2. Condemned Shellfish Area Number 003-146, shown as Section A, is established effective 23 September 2008. It shall be unlawful for any person, firm, or corporation to take shellfish from this area for any purpose, except by permit granted by the Marine Resources Commission, as provided in \u00a7 28.2-810 of the Code of Virginia. The boundaries of this area are shown on the map titled \u201cPopes Creek, Condemned Shellfish Area Number 003-146, 23 September 2008\u201d which is part of this notice.<\/p>\n

3. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.<\/p>\n

BOUNDARIES OF CONDEMNED AREA NUMBER 003-146<\/p>\n

A. The condemned area shall include all of Popes Creek and its tributaries upstream of a line drawn between latitude\/longitude map coordinate (38\u00b011'35.1\",-76\u00b054'22.6\") and map coordinate (38\u00b011'30.5\",-76\u00b054'14.5\").<\/p>\n<\/div>\n<\/div><\/div><\/div>
